Go2RAIL A.P.S. (“Associazione di Promozione Sociale”; hereinafter referred to as “Go2RAIL”) has developed a “Go2RAIL” platform (“Platform”) accessible on a website at the address www.go2rail.eu (hereinafter referred to as the “Site”), designed to connect international travellers interested in the same route for setting up groups and – where possible – provide them with promo codes aimed at making train tickets prices more affordable, and, where possible, additional discounts codes aimed at further customizing the travel experience or arrival at the intermediates and/or final destination. Therefore, the main purposes of the project can be summarized as follows:
(i) Facilitating the networking among people travelling on national and/or international routes;
(ii) When possible, providing them with relevant promo codes (and any further services that may be rendered) for making train tickets more affordable and/or further customizing the travel experience;
(iii) Putting them in contact for sharing information on the travel and helping them to meet new people;
(iv) Supporting the organization of travel groups by train at more affordable prices.
These Conditions apply to any and all uses of the Site and the Platform. By using the Site and/or the Platform, the users express their acceptance to these Conditions in full and agree to be bound by them.
In the event any user fails to comply with any of the provisions set out in the Conditions, Go2RAIL reserves the right to withdraw the user account – as hereinafter specified – and suspend or withdraw its activities carried out through the Site/Platform.
Go2RAIL reserves the right to update and modify the Conditions at any time. Users will be deemed to have accepted the modified version of the Conditions in the event that they access the Site or use the Platform following the publication on the Site of the varied Conditions.
Users of the Site and/or the Platform, as regards to the processing of their personal data, are invited to read the privacy policy (“Privacy Policy”) and the cookie policy (“Cookie Policy”), made available on the Site.
Neither Go2RAIL nor the Site/Platform provide any transport services nor Go2RAIL is involved in travel organization and as a consequence Go2RAIL cannot be qualified as a travel agency or travel organizer.
The activities carried out by Go2RAIL are strictly limited to facilitating networking among participants having completed the registration as per art. 5. (i) below (hereinafter referred to as “Participant(s)”) and providing Participants – where obtained – promo-codes for trains and additional discount codes (and any further services that may be rendered) to additionally customize the travel experience or the arrival at the intermediate or final destination (e.g., sustainable micro-mobility, hostels, books etc.), according to specific agreements reached by Go2RAIL.
Go2RAIL is not a party to any agreement or transaction between Participants and railway companies and will not be liable to either the Participant or the railway company involved. As a consequence of the above, the agreement for the rail travel shall be between each Participant and the railway company involved.
Each Participant interested in the Project is required to:
(i) Registration: Fill out the form, made available on the Platform/Site, providing the information requested by Go2RAIL at least 30 days before the date of departure; in particular, Participants will be required to provide information on their name, institutional email address, home institution, host institution and other information as required to fill the form or in any case as indicated in the Platform/Site. While, in case Go2RAIL´s value proposition is used for reaching a major event, such as a conference, Participants are required to provide, in particular, their name, email address, organization of affiliation, title of the covered position, departure city and other information as required to fill the form or in any case as indicated in the Platform/Site;
(ii) Communications by Go2RAIL: After having provided the information – as specified above – wait for the reply by Go2RAIL, which will be given via email at the latest within 10 days (or a different term as indicated on the Platform/Site) from the date of the departure, as indicated by the Participant; Go2RAIL reserves the right to communicate whether a promo code for trains is (or not) available for each Participant and – in the affirmative – provide the relevant promo-code to be applied to the final price of the rail travel document;
(iii) Use of discounts for trains: Once received the communication and promo-code for trains by Go2RAIL, get in touch and purchase the ticket directly with the railway company involved, in order to benefit from the price reduction, according to the discount percentage reserved to Go2RAIL;
(iv) Social media channels: Each Participant may get in contact beforehand with other Participants travelling on a same day to a same destination (i) by accessing the link to the relevant social media group and channels used by Go2RAIL (currently Telegram) or by any other means/modalities indicated by Go2RAIL. In the case under (i) above, every Participant will create autonomously its own account and provide the information requested by the social media platform concerned for the relevant access.
Additional discounts. Participants may get access to additional promo codes – where obtained by Go2RAIL – according to specific agreements, which Go2RAIL reserves to reach with commercial partners (see the list of partners on the Site). In such a case, said additional discounts – if any – shall be communicated by Go2RAIL via email and be used on the official webpage and/or stores of the relevant service provider. It is hereby agreed that the list of partners corresponding to the additional promo codes - if any - is subject to changes by Go2RAIL at its discretion and that the partners are updated regularly on the Site.
Special reimbursement for participants awarded with an Erasmus+ grant. In addition to the promo codes provided by Go2RAIL – if any, as specified above – participants awarded with an Erasmus+ grant have access to the “green travelling top-up” granted by the European Commission, administered according to the relevant guidelines and limitations (see https://erasmus-plus.ec.europa.eu/programme-guide/part-b/key-action-1/mobility-projects-for-higher-education-students-and-staff#:~:text=Students%20and%20recent%20graduates%20not,a%20return%20trip%2C%20if%20relevant or any official source of the European Commission), and that is reserved to Erasmus+ participants that have decided to travel sustainably for their exchange period.
Go2RAIL shall not be considered by any means responsible for the distribution of such reimbursement, rather participants are supposed to reach out to the relevant office at their institution (e.g., internationalization office, Erasmus office etc.) to understand and carry out all the relevant steps that are foresee by their institution to receive the additional financial support in question.
Participants accept and recognize that:
(i) Go2RAIL is not a party to any agreement or transaction between Participants and railway companies and will not be liable to either the Participant or the railway company involved;
(ii) All the information provided to Go2RAIL through the Platform shall be true, accurate and complete in all respect and that Go2RAIL shall not make any verification to confirm the accuracy of the information provided by each Participant;
(iii) Go2RAIL will not be liable toward any Participant in the event that any information provided through the Platform is false, incomplete, inaccurate or incorrect;
(iv) Go2RAIL will not be liable toward any Participant in the event of inappropriate behaviours and/or communication on the relevant social media group or during the travel experience;
(v) The promo codes communicated by Go2RAIL (including those for trains and the additional ones, as specified above) shall be used (i) in compliance with the terms and conditions established by Go2RAIL as well as with all the instructions given by Go2RAIL, communicated through the Platform/Site or via email; and also (ii) according to the instructions provided on the official webpage or through other means of the service provider following its terms and conditions;
(vi) The promo code for trains communicated by Go2RAIL is only valid for a single Participant and a single rail travel and may not by assigned to or used by any other person or Participant;
(vii) Any additional discount or promo code communicated by Go2RAIL is only valid for a single Participant and may not be assigned to or used by any other person or Participant.
Participants accept and recognize that Go2RAIL shall not have any obligation to provide any discount of any nature to Participants, since such activity will depend on variables beyond the control of Go2RAIL, including inter alia the number of participants and the agreement reached respectively with railway companies and/or additional service providers or commercial partners.
As a consequence of the above, Go2RAIL shall not be responsible for any failure and/or damage which may be suffered by Participants in connection with discounts and/or rail travels (for instance, failure by railway companies/local shops to accept the discounts/promo-codes provided by Go2RAIL, among others train delays, trip cancellations etc.).
Go2RAIL shall try as far as possible to maintain the Platform/Site accessible 7 days a week and 24 hours a day. Nevertheless, access to the Platform/Site may be temporarily suspended, without notice to Participants, owing to technical maintenance, migration or update operations, provided however that said suspensions or non-availability of the Platform/Site shall not in any way constitute any assumption of any liability by Go2RAIL.
The format and contents included in the Site, such as, in particular, texts, graphics, logos, button icons, images, audio clips and software are the property of Go2RAIL or its providers.
All rights are reserved in relation to any registered and unregistered trademarks (whether owned or licensed to Go2RAIL) which appear on the Site.
The Site or any portion of the Site may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose whatsoever.
Go2RAIL invites the Participants to communicate any kind of disservice they deem to have suffered, as well as any kind of dissatisfaction, in order to find a friendly solution. In case of a dispute arise, the Participants may submit a complaint via the ODR platform established by the Regulation (EU) n. 524/2013, filling in the electronic form available in the official languages of the European Union.
Notwithstanding mandatory provisions of laws and regulations that can’t be derogated (for example, consumer law provisions prescribed by the law of the land applicable to the relevant Participants), these Conditions are exclusively regulated and governed by the Italian law and any disputes arising out in relation to these Conditions shall be subject to the exclusive jurisdiction of the Courts of Bologna (Italy).
